1. Service description

NodeBooth is an Android mobile app that lets users create and publish a standalone online shop from their smartphone.

• The app embeds locally the components needed to run the shop, including the web interface, settings and certain backend features.
• Shops run directly from the user's mobile device through network tunnels or relay services.
• NodeBooth allows the use of cryptocurrencies as a means of payment. Transactions take place directly between buyers and sellers.
• Some network features may depend on third-party providers or relay services offered by NodeBooth.
• NodeBooth acts solely as a software tool provider and does not take part in the commercial activities carried out through the shops.
• Shops are not hosted centrally by NodeBooth but directly from users' devices.
• NodeBooth does not act as a marketplace, a payment intermediary, or a cryptocurrency exchange platform.

2. Nature of the service

NodeBooth is built on a standalone architecture where each user directly controls their own shop.

• A significant part of the technical operation runs directly on the user's smartphone.
• Each user is solely responsible for the configuration, content and administration of their shop.
• NodeBooth never intervenes in the sales, payments or exchanges made between users and customers.
• For shops published over a standalone connection — whether a built-in free tunnel option or an SSH tunnel the user sets up themselves (Standalone offer) — NodeBooth does not review, monitor or snapshot the content, products or services; the user is solely responsible.
• For shops served through the NodeBooth managed relay (Hosting offer), the shop's publicly served content is automatically scanned for compliance with these Terms — see section 5 (prohibited content) and section 13 (moderation & suspension).
• NodeBooth never has access to users' cryptocurrencies or sensitive wallet information.

3. Non-custodial service

• Funds remain entirely under users' control and never pass through NodeBooth servers.
• NodeBooth does not collect, store or transmit any recovery phrase or private key.
• Wallets used with the app remain entirely the responsibility of their owners.
• In the event of loss of seed, wallet or device access, NodeBooth will not be able to restore lost funds.
• It is up to users to make and securely keep their backups.
• Updating the app (installing a newer version over the existing one, signed with the same key) preserves your wallet and settings. However, uninstalling then reinstalling the app — or resetting/losing the device — erases the local wallet.
• Best practice: write down your recovery phrase (seed) on paper and keep it offline. Without this backup, funds cannot be recovered after an uninstall, device reset or loss.

4. Conditions of use

By accessing NodeBooth, you declare and accept that you:

• Are of legal age and have the legal capacity required in your country.
• Will comply with the regulations applicable in your jurisdiction.
• Will only use the app for lawful and authorized activities.
• Take full responsibility for the goods, services and content offered through your shop.
• Will meet your tax and regulatory obligations relating to cryptocurrencies.
• Will not engage in fraudulent, abusive or deceptive activities through the service.

We reserve the right to suspend or delete any account that fails to comply with these terms, without notice and without any obligation to refund.

5. Prohibited activities

• Illegal products: selling goods or services prohibited by law.
• Drugs / weapons / counterfeits: content related to narcotics, weapons or fake products.
• Forged documents: creating or distributing falsified documents.
• Phishing / malware / scam: cyberattacks, scams or malicious software.
• Financial fraud: fraudulent schemes, swindles or illegal systems.
• Money laundering: use intended to hide the origin of funds.
• Economic sanctions violations: non-compliance with international sanctions and regulations.
• Unlawful or dangerous content: violent, hateful or illegal content.
• Network abuse: spam, deliberate overload or technical exploitation of the services.

6. Infrastructure & network tunnels

• Some network features rely on external technologies or providers (several free tunnel options, relay, SSH tunnels).
• NodeBooth does not guarantee continuous availability of network services.
• Interruptions may occur due to issues with third-party services.
• The service may experience slowdowns, interruptions or technical restrictions beyond our control.
• NodeBooth does not control the terms or policies of external providers.
• Where a user configures their own SSH tunnel (their own server or a third-party tunnel service), they are solely responsible for that tunnel — its setup, security, availability and compliance with the provider's terms. NodeBooth provides no support or guarantee for user-configured tunnels and does not monitor the shops served through them.
• Users remain responsible for the shops published through these network infrastructures.

7. Subdomains & premium relay

• Some premium services may provide NodeBooth subdomains or custom URLs.
• These services aim to improve the stability and accessibility of shops.
• NodeBooth may suspend access to premium services in case of abuse.
• Some features may be interrupted immediately for security or compliance reasons, without notice.
• NodeBooth may take any measure necessary to protect its services and infrastructure.
• Mechanisms may be put in place to limit malicious uses (phishing, spam, fraud).

8. Cryptocurrencies & blockchain

• Irreversible transactions: blockchain transactions generally cannot be reversed once confirmed.
• Financial risks: users acknowledge the risks associated with digital assets.
• Volatility: cryptocurrencies can undergo large swings in value.
• Network fees: blockchain fees can vary greatly depending on network congestion.
• Address errors: a wrong destination can lead to permanent loss of funds, with no possible recourse.
• User responsibility: users must verify amounts, addresses and confirmations themselves.
• No blockchain guarantee: NodeBooth guarantees neither the availability nor the security of the third-party blockchains used.
• Privacy-enhanced cryptocurrencies: some cryptocurrencies supported by the app (notably Monero/XMR) offer advanced privacy features. Their regulatory status varies by country — some jurisdictions impose specific restrictions on their commercial use. It is solely up to the user to verify legal compliance in their jurisdiction before any use.

9. User security

• Users must secure their device against unauthorized access.
• Credentials and passwords must remain strictly confidential.
• Regular backups of sensitive data are strongly recommended.
• Rooted or modified devices may pose increased security risks.
• Malware can compromise the security of wallets and local data.
• Users must keep their device and the app up to date.
• Loss or destruction of the phone can lead to permanent loss of unsaved local data.

10. Personal data & privacy

NodeBooth applies a principle of data minimization. Full details are in the Privacy Policy below.

• Email: used only for authentication and essential transactional communications.
• Shop data: stored locally on the device — it does not pass through our servers.
• Wallets & seeds: NodeBooth never stores this information.
• Blockchain transactions: recorded on the relevant public blockchain or decentralized network, outside our control.
• GDPR compliance: NodeBooth complies with the applicable French and European regulations.

11. Limitation of liability

To the extent permitted by applicable law, NodeBooth and its developers cannot be held liable for:

• Financial losses resulting from use of the app or cryptocurrency transactions.
• Service interruptions, bugs or technical malfunctions.
• Data loss or wallet compromise resulting from improper use.
• Disputes between sellers and buyers using the service.
• Use that does not comply with the user's local regulations.
• No guarantee of revenue or commercial or financial outcome.
• No guarantee of compatibility on all devices or Android versions.

The service is provided "as is", without any express or implied warranty of any kind.

12. Bugs & technical risks

• Like any software, NodeBooth may contain errors or technical defects.
• Unknown security vulnerabilities may exist despite security efforts.
• Data loss or corruption may occur.
• Network connections may be interrupted for independent technical reasons.
• Some features may not work on all Android devices.
• Some functions depend on external services and APIs.
• The blockchains used may experience incidents independent of NodeBooth.

13. Suspension & termination

• NodeBooth may suspend certain access in case of suspicious or abusive activity.
• Automated content moderation (Hosting offer only): shops served through the NodeBooth managed relay have their publicly served content — shop name, description, announcements and product titles & descriptions — automatically scanned against a prohibited-content list (section 5) each time the app connects to the relay, and periodically while online.
• Where a breach is detected, NodeBooth may — automatically or after human review — suspend or revoke the hosted shop: its managed relay tunnel is shut down and its public URL goes offline. The affected user is informed of the reason in their dashboard, and the app remains usable in standalone mode where the APK is owned. This moderation applies only to shops using the managed relay, not to shops the user runs over their own tunnel — whether a built-in free tunnel option or an SSH tunnel the user configures themselves.
• Relay or tunnel services may be disabled at any time for technical or legal reasons.
• NodeBooth subdomains may be suspended for legal or technical reasons.
• Any violation of these Terms of Use may result in immediate termination, without notice or refund.
• NodeBooth may cooperate with the competent authorities where required by law.

14. Intellectual property

All elements making up NodeBooth (logo, interface, source code, documentation) are the exclusive property of their authors and protected by applicable intellectual property laws.

• Any unauthorized reproduction of the code or graphic elements is prohibited.
• Commercial redistribution without prior written authorization is prohibited.
• Some components may rely on third-party open source licenses, whose terms apply independently.

15. Service changes

• NodeBooth may modify or improve certain features at any time.
• These Terms of Use may be updated periodically. The update date is shown in the header.
• Premium services may evolve or change pricing with prior notice.
• Some functions may be discontinued for technical or strategic reasons.

Your continued use of the service after the Terms are modified constitutes acceptance of the new terms.

16. Governing law

These Terms of Use are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the competent French courts will have jurisdiction.

In the event of a translation discrepancy, the French version of these Terms of Use prevails.

1. Object

These Terms of Sale define the conditions under which NodeBooth sells its software offers on nodebooth.app to any user making a purchase or taking out a subscription.

Any order implies unreserved acceptance of these Terms of Sale and the Terms of Use.

2. Offers & pricing

• Standalone APK — 149 € one-time: permanent access to the NodeBooth APK, updates included with no time limit. 5 free tunnel options built into the app.
• NodeBooth Hosting — 49 € + 15 €/month: 49 € upfront for the APK, then 15 €/month for the stable tunnel hosted by NodeBooth + custom URL + web dashboard. The APK becomes permanently yours once 149 € total is paid (or buy out the balance anytime); cancel earlier and the APK stops while only the hosting was rented.

Prices are shown in euros including tax. NodeBooth reserves the right to change its prices with 30 days' notice for ongoing subscriptions, notified by email.

3. Order & payment

Payments are processed exclusively by Stripe (PCI-DSS Level 1 certified). At no point does NodeBooth collect, see or store your banking data.

• You may order either after creating an account, or directly before creating one (pay-first). In the pay-first case, your account is created afterwards and is bound to the email address used for the Stripe payment.
• The order is confirmed by email after the Stripe payment is validated.
• Access to the APK download and the dashboard is enabled immediately after confirmation.
• If a subscription payment fails, Stripe makes several automatic retries before suspension.
• Invoices are available in your dashboard and sent by Stripe by email.

4. Right of withdrawal

By downloading the APK or activating the Hosting service, you expressly acknowledge that you waive your right of withdrawal for this order. For subscriptions: no refund of the current month is made in case of cancellation.

5. Subscription cancellation

• Cancellation is done from your dashboard, "Subscription" section.
• It takes effect at the end of the current monthly period — no prorated refund.
• After cancellation, the hosted tunnel and dashboard are disabled. The APK remains functional in standalone mode.
• NodeBooth may cancel a subscription in case of violation of the Terms of Use, without refund.

6. Availability & support

• NodeBooth undertakes to provide the service as described, without any guarantee of continuous availability.

• Planned interruptions will be notified by email with reasonable notice.

7. Governing law

These Terms of Sale are subject to French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the competent French courts will have jurisdiction.

In accordance with Articles L612-1 et seq. of the French Consumer Code, any consumer may use a consumer mediator free of charge.

2. Data collected & purposes

NodeBooth applies the minimization principle: only the strictly necessary data is collected.

* 5 years for billing data — French legal obligations (Commercial Code).

3. Analytics & cookies

NodeBooth uses an in-house analytics tool, hosted on its own servers. No third-party tool (Google Analytics, Meta Pixel, etc.) is used.

What is collected: pages visited, traffic source (referrer), device type (mobile / desktop), browser language.

Unique visit counting without IP: an anonymous session identifier is generated on each visit via a session cookie and a non-reversible fingerprint based on generic browser characteristics. This identifier cannot re-identify a user and expires when the browser is closed.

• Flask session cookie (authentication) — functional, expires when the browser closes. No consent required.
• Anonymous analytics cookie (session only) — functional, expires when the browser closes. No consent required.

No advertising cookies, no third-party tracking cookies, no persistent cookies without consent.

4. Processors & transfers

• Stripe Inc. (USA) — payment processing. Transfer governed by the European Commission's standard contractual clauses. Stripe Policy →
• Infomaniak Network SA (Switzerland) — hosting of nodebooth.app. Switzerland has an adequacy decision from the European Commission.

No personal data is sold, rented or transferred to third parties for commercial purposes.

5. Retention periods

• User account: account lifetime, then deletion within 12 months of closure or last activity.
• Billing data: 5 years (legal obligations, French Commercial Code).
• Tunnel logs: 30 rolling days, automatic deletion.
• Analytics: aggregated data kept for 12 months, with no possibility of re-identification.
• Marketing email sequence: until unsubscription or deletion request.

6. Your rights

In accordance with the GDPR (EU Regulation 2016/679) and the French Data Protection Act, you have the following rights:

• Access: obtain a copy of your personal data.
• Rectification: correct inaccurate or incomplete data.
• Erasure: request deletion of your data ("right to be forgotten").
• Portability: receive your data in a structured, readable format.
• Objection: object to processing based on legitimate interest.
• Restriction: request the temporary suspension of processing.

7. Security

• Passwords are hashed (secure algorithm) — never stored in clear text.
• Communications between your browser and nodebooth.app are encrypted (HTTPS/TLS).
• Access to data is restricted to strictly authorized persons.
• In the event of a data breach likely to affect your rights, you will be notified within the timeframes set by the GDPR (72h to the CNIL, without undue delay for the data subjects).
